Distance Sale Contract for BlueRos

ARTICLE 1 – SUBJECT OF THE AGREEMENT AND THE PARTIES

1.1. Overview

This contract defines the rights and obligations of the parties in line with the Law No. 6502 on Consumer Protection and the Regulation on Distance Contracts. Details on the delivery of products ordered via BlueRos’s website (referred to as the WEBSITE) are outlined below.

1.2. Consumer Acknowledgment

The consumer acknowledges and confirms understanding of the basic qualities, sales price, payment method, delivery conditions, and “right of withdrawal” related to the goods or services. The consumer agrees to these terms as detailed in the preliminary information and invoice found on the WEBSITE’s payment page, which are integral parts of this contract.

ARTICLE 2 – AGREEMENT DATE

This contract is effective on the date when the consumer completes an order on the WEBSITE and a copy of the contract is sent to the consumer’s e-mail address.

ARTICLE 3 – PRODUCTS AND SERVICES

Details of the ordered products, including prices, taxes, and quantities, are listed below. All products in this list are referred to as Products.

ARTICLE 4 – DELIVERY OF PRODUCTS

  • 4.1. Delivery Timeline: The product will be delivered to the specified address within 30 days, complete with packaging and invoice.
  • 4.2. Delivery to Third Parties: If the delivery is to a third party, the seller is not responsible for non-acceptance.
  • 4.3. Damage Inspection: The consumer should inspect the product upon receipt. If there is damage related to shipping, the consumer should not accept the product and file a report with the shipping company. The seller is not liable for damages accepted by the consumer.

ARTICLE 5 – PAYMENT METHOD

Details on payment methods, interest rates, and default policies are as per the agreement with the consumer’s bank or financial institution. In case of payment default, a monthly delay interest of 5% is applied.

ARTICLE 6 – GENERAL PROVISIONS

  • 6.1. Consumer Acknowledgment: The consumer acknowledges having read and understood all necessary pre-sale information.
  • 6.2. Contract Confirmation: By confirming this contract electronically, the consumer confirms accurate receipt of all product and sale details.
  • 6.3. Seller’s Responsibility: The seller is responsible for delivering the product in good condition and as described.
  • 6.4. Substitute Products: The Seller may provide a substitute product of equal quality and price.
  • 6.5. Impossibility of Fulfillment: If the product cannot be supplied, the seller must inform the consumer and refund any payments within 14 days.
  • 6.6. Payment Failure: If the product price is not paid or is canceled in bank records, the Seller is exempt from delivering the product.
  • 6.7. Return Policy: In case of non-payment, the product must be returned to the Seller at the consumer’s expense.

ARTICLE 7 – PRODUCT DELIVERY PROCESS

  • 7.1. Delivery Timeframe: Products will be delivered within 7 days to the specified address.
  • 7.2. Third-Party Delivery: The seller is not responsible if a third party refuses the delivery.
  • 7.3. Damage Inspection: The consumer must inspect and report any shipping damages immediately.

ARTICLE 8 – RIGHT OF WITHDRAWAL

  • 8.1. Withdrawal Period: The consumer has a 14-day right of withdrawal without penalty.
  • 8.2. Exceptions to Withdrawal: Certain goods (customized items, perishables, unsealed goods, etc.) are exempt from the right of withdrawal.
  • 8.3. Refund Process: Upon withdrawal, the seller must refund all payments within 14 days.
  • 8.4. Product Use Liability: The consumer is not liable for any change or deterioration in the product if used as intended.
  • 8.5. Return Costs: The consumer is not liable for return costs if using the courier specified by the seller.
  • 8.6. Return Timeline: The consumer must return the goods within 10 days of exercising the right of withdrawal.
  • 8.7. Personalized Products: There is no right of withdrawal for personalized products.
  • 8.8. Cancellation Policy: Orders at the “Delivery to Courier” stage cannot be canceled.
  • 8.9. Return Process for Undelivered Orders: Consumers must return the product unopened for orders at the “Delivery to Courier” stage.

ARTICLE 9 – EVIDENCE AGREEMENT AND AUTHORIZED COURT

  • 9.1. Dispute Resolution: Seller’s records constitute conclusive evidence in disputes. Consumer Courts and Arbitration Committees are authorized for dispute resolution.
  • 9.2. Contract Acceptance: The consumer acknowledges understanding and accepting all terms of this Agreement.
